More Information Required in Case Against Brighton School Board Trustee

A local judge granted the defense a motion for discovery.

Prosecutors in the case against Brighton School Board Trustee John Conely will be required to turn over more information to his defense attorney after 44th Circuit Court Judge Michael Hatty granted a motion for discovery, WHMI radio reported Monday. Conley is charged with felony assault and reckless driving

Conely, 49, is accused of intentionally ramming a tow truck that was repossessing a Chevrolet Avalanche from the lot of his car dealership, Conely Auto Sales on Aug. 26.

Conely's attorney, Neal D. Nielsen, told Brighton Patch that his client believed the Avalanche was being stolen at the time of the incident.

According to WHMI radio, The motion will require prosecutors to provide Neilson with the names of potential witnesses as well as any witness statements pertaining to the case. The motion will also allow Neilson to inspect any physical evidence the prosecution may produce during trial barring information from the Law Enforcement Information Network (LEIN).

Prosecutor David Morse told WHMI that LEIN system information cannot be ordered for discovery as it’s prohibited under state policy.

Conely heads to trial December 19th unless a plea deal is reached prior.
